Alimony

Generally speaking, an award of alimony is based upon the ability of one spouse to pay and the need of the other spouse for support. The court is to take into account the factors that are set forth in the applicable statute. However, alimony is not usually a consideration in a short-term marriage where both parties are employed. It is more likely to be awarded in a long-term marriage, more than 20 years, where one spouse remained at home during the marriage and there is a large disparity in income between the spouses.
